Michael S. Gerton
Michael’s practice focuses on estates and trusts, disability law and education law. A graduate of the University of Maryland School of Law and the University of Rochester (High Distinction), he has also received a Certificate in Special Education Advocacy from William & Mary Law School. Michael is admitted to practice in Maryland and the District of Columbia.
Michael regularly provides representation to clients who have encountered suspensions, expulsions, student conduct violations, academic sanctions and other disciplinary issues from elementary school all the way through postsecondary (college and graduate) settings. He also delivers services related to IEPs, 504 Plans, state and due process complaints, school transfers (e.g. COSA), grade grievances, bullying and Title IX.
Additionally, Michael is an experienced mediator listed on the approved practitioner rosters for the Circuit Courts for Montgomery and Frederick Counties and the District Court for Montgomery County. He is a frequent contributing writer and guest speaker on various legal topics, including recent programs sponsored by the Maryland State Bar Association and CHADD (Children and Adults with ADHD).
Prior to joining Fierst & Fink, P.C., Michael represented students in school discipline and special education matters throughout the Washington Metro area and beyond. He also worked on behalf of classes of collegiate athletes in various intellectual property, antitrust and consumer protection actions, including seminal student-athlete cases In re: NCAA Student-Athlete Name & Likeness Licensing Litigation, Agnew v. NCAA, Rock v. NCAA and Lightbourne v. Printroom.
In addition to donating pro bono legal services to groups such as Wills for Heroes, Disability Rights Maryland and Xtraordinary Minds, Michael is an active member of CHADD’s Public Policy Committee and serves on the Board of Directors of the nonprofit Team Up For 1. His professional memberships include the Maryland State Bar Association, Bar Association of the District of Columbia and Bar Association of Montgomery County.
